These Terms of Service (“Terms”) apply to your use of our website and to any purchases made through our online store.
If you are a consumer, nothing in these Terms limits your statutory rights under applicable consumer protection law.

2. USE OF THE STORE
By using this Store or placing an order, you confirm that you are legally capable of entering into a binding contract.
The contract language is English.
We may update or change the Store, product offering, or these Terms from time to time. Any such changes will not affect orders already accepted by us.
3. PRODUCTS
We make reasonable efforts to ensure that product descriptions, images and prices are accurate.
Because screen settings and devices may display colours differently, we cannot guarantee that colours shown on your screen will exactly match the actual product.
All products are subject to availability. We reserve the right to withdraw or amend products at any time.
If a product is made to order, personalised, or otherwise exempt from the standard right of withdrawal, this will be clearly stated on the relevant product page.
4. ORDERS AND CONTRACT CONCLUSION
By placing an order, you submit an offer to purchase the selected product(s).
The purchase contract is concluded when we send you an order confirmation email accepting your order.
We reserve the right not to accept an order in justified cases, including where:
- the product is unavailable,
- there is an obvious pricing or product description error,
- we reasonably suspect fraudulent activity, or
- we are unable to fulfil the order for legal or operational reasons.
If we do not accept your order after payment has been made, we will refund you in full without undue delay.
If you wish to cancel an order before dispatch, please contact us as soon as possible at info@nicolamackova.com. We will try to accommodate your request where possible. This does not affect any statutory right of withdrawal you may have as a consumer.
5. PRICES AND PAYMENT
All prices are displayed in EUR.
The total price payable, including any applicable taxes and delivery charges, will be shown before you place your order.
Payment methods accepted by us are shown at checkout.
We may require full payment before dispatching the order, unless stated otherwise.
For deliveries outside the European Union, customs duties, import taxes or other local charges may apply and are the responsibility of the customer unless stated otherwise.
6. SHIPPING AND DELIVERY
Information about shipping methods, delivery areas, delivery times and shipping charges is set out in our Shipping Policy and shown at checkout.
Any delivery times provided are estimates only. We are not liable for delays caused by circumstances beyond our reasonable control, including carrier delays or customs processing.
If you are a consumer, the risk of loss of or damage to the goods passes to you when you, or a third party designated by you other than the carrier, take physical possession of the goods.
7. RIGHT OF WITHDRAWAL FOR CONSUMERS
If you are a consumer, you have the right to withdraw from the purchase contract within 14 days without giving any reason.
The withdrawal period expires 14 days after the day on which you, or a third party indicated by you other than the carrier, receive the goods.
To exercise your right of withdrawal, you must inform us of your decision by a clear statement sent to info@nicolamackova.com or to the postal address listed above.
You must send the goods back to us without undue delay and no later than 14 days from the day on which you notify us of your withdrawal. The deadline is met if you send the goods back before the 14-day period has expired.
If you validly withdraw from the contract, we will refund all payments received from you, including the cost of the cheapest standard delivery method offered by us.
If you chose a delivery method other than the cheapest standard delivery method offered by us, we are not required to reimburse the additional cost.
We will issue the refund without undue delay and no later than 14 days from the day we receive your withdrawal notice. However, we may withhold the refund until we have received the returned goods or until you provide proof that you have sent them back, whichever is earlier.
We will make the refund using the same payment method you used for the original transaction, unless we expressly agree otherwise.
Unless the goods are faulty, damaged or incorrectly supplied, you are responsible for the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and fit of the goods.
The right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalised.

8. DEFECTIVE, DAMAGED OR INCORRECT GOODS
Your statutory rights relating to defective, damaged or non-conforming goods are not affected by these Terms or by our Return & Refund Policy.
If you receive goods that are defective, damaged or not as ordered, please contact us without undue delay at info@nicolamackova.com.
Complaints may be submitted by email or by post to the contact details listed above.
If any commercial guarantee is offered in relation to a product, its terms will be stated separately.
9. INTELLECTUAL PROPERTY
All content on this Store, including text, photographs, graphics, logos, branding and design elements, is owned by us or used under licence.
You may use this Store only for personal, non-commercial purposes. You must not copy, reproduce, distribute, modify or otherwise use any content without our prior written consent.
10. PRIVACY
We process personal data in accordance with our Privacy Policy.
Our store is hosted on Shopify. However, any purchase contract for products sold through this Store is concluded directly between you and us.
11. WEBSITE AVAILABILITY
We do not guarantee that the Store will always be available without interruption or error.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
12. GOVERNING LAW AND CONSUMER DISPUTES
These Terms and any purchase contracts concluded through this Store are governed by the laws of the Czech Republic.
If you are a consumer residing in another EU Member State, you also benefit from any mandatory provisions of the law of your country of habitual residence that cannot be derogated from by agreement.
If a consumer dispute arises between you and us and cannot be resolved directly, you may submit a proposal for out-of-court dispute resolution to the Czech Trade Inspection Authority (Česká obchodní inspekce), which is the competent body for out-of-court consumer disputes relating to our products.
